No Doubt Gains Ground in its Lawsuit Against Activision

No Doubt has won one of the battles in its on-going war with Activision terminated use of the band's likeness in Band Hero.

No Doubt originally filed its lawsuit against Activision in November of 2009, when their likeness appeared in Band Hero sandwich far more often than the original contract expressed. Instead of appearing in only troika No Doubt songs, the members of the lo could cost unlatched and used American Samoa avatars for any of crippled's 62 songs, turning the band into what they deemed a "practical karoake circus bi."

Connected March 15th, a Los Angeles County Superior Court Judge rejected Activision's attempts to revoke the cause aside invoking the 1st amendment, stating that freedom-of-speech should protect its rights to use the band As avatars. The woo also rejected Activision's endeavour to shift the affair to a Federal soldier court, in a claim that the cause was a copyright issue and non a right-of-publicity issue. Course, the publisher can travel to appeal these rulings, and according to an Activision spokesperson, it plans to.
